Four months after fire, building's rubble remains downtown eyesore

JACKSONVILLE, TX (KLTV) - More than four months after a downtown Jacksonville building went up in flames, local businesses say it is now time to clean up the rubble. However, the city says part of the problem is the building's owner did not have insurance. Residents say it is time for somebody to take responsibility for its removal.

"The owners are not going to do anything," said local business owner Emily Griffin. "The city is not going to do anything. The people are unable to do anything without a permit from the state. I'm just stuck in the middle."

Griffin owns Snaps Photography, a store right next door to what was formerly the Yum Yum restaurant.

"My studio... I had several people renting out the other building and they had small businesses," she said. "I'd love to have that again."

It is an issue garnering enough support that the mayor held a special meeting Wednesday.

Griffin wants the city to tear down the remainder of the building so she can allow insurance adjustors into her space. As of now, Griffin has only received a partial insurance reimbursement and is unable to begin demolishing and rebuilding until something is done about the now-abandoned neighboring building.

However, the city said it is not their responsibility to clean up private property.

"Public property was at risk and in danger, so we cleaned public property up," said Jacksonville Public Works Director Will Cole. "We can't spend on non-public projects. If it's private property, it's illegal to spend funds"

But the city admits they have neither fined the owner or sent out any notices for cleanup. They promise that will come soon.

"It's just at this point where's it's stalled out and we need to take action and take control of it," Cole said.

Griffin said all she wants is action.

"I can leave my two buildings sitting here as well," she said. "That leaves three vacant downtown buildings that are eyesores. I can pack up and move on, but I don't want to do that, because that would not benefit this town."

The board of adjustments and appeals will meet in early October to discuss the fate of the building. Among their options are fining the owner or seizing the property.

Attorney files official complaint against East Texas district judge

SMITH COUNTY, TX (KLTV) -

An official grievance has been filed against a Smith County judge who ordered deputies to arrest a Tyler attorney at his dying aunt's bedside.  

In July, longtime defense attorney Clifton Roberson was considering taking action against Smith County 114th District Court Judge Christi Kennedy. Roberson says he was brought to the courthouse in handcuffs when he went to see his aunt in the hospital instead of going to a hearing. Roberson's attorney says the complaint was filed with the Texas State Commission on Judicial Conduct last week.

The complaint and any results from the commission's investigation could remain confidential, unless the review board takes public action against the judge.

Courthouse reopened after Smith Co. gas leak

TYLER, TX (KLTV) -

The Smith County Courthouse has now reopened after closing during a gas leak at Smith County Jail Tuesday afternoon.

According to John Moore with the Smith County Sheriff's Office, the gas leak has been repaired by CenterPoint Energy and the courthouse has been reopened. Downtown Tyler is under a voluntary evacuation and some businesses have sent employees home for the day. Air monitoring has been conducted in the area and the atmosphere has been deemed safe.

Ferguson Street, Broadway Avenue, Fannin Avenue and Erwin Street near the jail were all closed

Emergency crews responded to a gas leak at the Smith County Jail around 12:07 p.m. Work crews hit a newly-installed four inch gas line while digging, causing it to rupture. The Smith County Courthouse and several surrounding buildings were evacuated.

Celebrate National Peaches & Cream Day: Peaches & Cream French toast casserole

June 21 is National Peaches and Cream Day; 38% of all the world's peaches are grown in the U.S., and Texas boasts some really delicious peaches!

Whether you have fresh peaches to use, or canned, try out this easy recipe that your family will enjoy for breakfast or brunch!

Peaches and Cream French toast casserole:

Ingredients:

3-4 cups sliced peaches (fresh, or 2- 15oz. canned peaches)

1 - 8oz loaf of French bread, sliced

8 eggs

2 cups 2% or whole milk

1/4 cup white sugar

1 tsp vanilla extract

1/2 cup packed brown sugar

1/2 to 1 tsp ground cinnamon

1/2 cup heavy cream

1. Spray or butter a 9x13' casserole dish. Arrange bread slices in the bottom, as tightly fitting as possible.

2. In a large mixing bowl, whish together all eggs and milk, then add sugar and vanilla. Whisk until dissolved.

3. Pour egg mixture over bread, and then arrange peach slices all over then top, distributing evenly.

4. Sprinkle with brown sugar and cinnamon, then cover tightly and refrigerate overnight, or at least 8 hours.

5. Remove baking dish from fridge and uncover 30 mins prior to baking.

6. In the meantime, place 1/2 cup cream in a sauce  pan, and simmer until reduced by half.

7. Pour the thickened cream over the casserole, and then bake, uncovered, for about 45 - 55 minutes at 350 degrees F.

8. Let stand for ten minutes before serving.

Traffic now flowing on Loop 323 after train strikes forklift

TYLER, TX (KLTV) -

Traffic is now flowing on northeast Loop 323 after a train accident Wednesday afternoon.

A man on a forklift was operating the machinery near the railroad tracks on Loop 323 near Highway 271 when the forks on the equipment became stuck underneath the tracks.

The operator attempted to move the forklift but the machine would not budge. A train began traveling southbound on the tracks towards the forklift shortly after it became stuck. The machine's operator attempted to alert the train's conductor, but the mile long train was unable to stop. The operator managed to jump from the forklift before the locomotive made impact.

The train struck the forklift and derailed. No injuries were reported.

E. Texas representatives weigh in on possible Syria deal

(KLTV) - East Texas representatives said Tuesday’s developments only make them more confident that military action is not the solution in Syria. Texas leaders in Congress have been vocally opposed to the use of force in the region over the last few weeks, many promised to vote no if taken to a vote.

Tyler Liberty Alliance president Joseph Yazdanpanahi believes the deal between Russia and Syria is one the government should be considering.

“We should be skeptical,” he said. “But at the same time, we should do what is in America's best interest and sending a bomb over to Syria and killing more people doesn't seem like a solution.”

Yazdanpanahi lead a rally last week against US intervention in Syria.

“If we do send a bomb over there, how is that going to stop more chemical weapons from being used?” he said. “What about retaliation? Is Iran going to retaliate? They are allies with Syria”

Local leaders in Washington agreed. US representative Jeb Hensarling held a telephone town hall Monday night. He said after talking with East Texas residents, “It is clear that the American people are not convinced of the need to move forward with the President’s plan.”

“This is a very bipartisan issue,” said US Representative Louie Gohmert. “The people on both sides of the aisle, I’d say a majority, are not supportive of the President striking in Syria.”

Yazdanpanahi, who still has an aunt living in the region, said it comes down to bigger problems to tackle here at home.

“With all of the conflicts, with the national debt crisis, with the economic situation, why would we want to have any more involvement that's not in our absolute best interest and an absolute necessity?” he said.

The president has scheduled an address to the nation on the issue for Tuesday at 8 p.m.

ETX motorcyclist recovering after serious wreck

LONGVIEW, TX (KLTV) -

An East Texas motorcyclist who was injured in a wreck last week has a long recovery road ahead of him.

JC Chavis, 57, of Longview, has been moved out of ICU after being hit by a truck in a wreck on September 4.

Longview Police say 60-year-old Jimmy Mayfield, of Longview, was turning left on Spur 63, in front of the Whataburger near Highway 80, when he hit Chavis. According to police, Mayfield was issued a ticket for failure to yield the right of way.

Chavis' family members say he is recovering from a broken leg, dislocated shoulder and a concussion. They say he will need physical therapy to walk again.

Tree splits E. Texas home during afternoon storm

LONGVIEW, TX (KLTV) - A tree nearly split an East Texas home in half Wednesday afternoon.

A female homeowner was inside the house, located on the 600 block of Oakdale Avenue in Longview, when the tree fell. She was not injured and was able to walk out of the home unscathed.

Firefighters on scene suspect that high winds from the afternoon storms knocked down the tree.

Accident sends car into East Texas lake

HENDERSON COUNTY, TX (KLTV) -

Emergency crews responded to an accident Wednesday afternoon at Lake Palestine.

According to Texas Department of Public Safety Trooper Jean Dark, troopers are assisting local fire crews at the scene of an accident involving a vehicle that went into Lake Palestine. The vehicle, an SUV, is almost entirely submerged in the water at this time.

The driver of the vehicle says she accidentally put the car into drive instead of reverse and drove into the lake. She made it out of the car without injury and swam to shore.

The Noonday Volunteer Fire Department responded to the scene. Crews are trying to figure out how to retrieve the SUV from the lake. 

The accident is at the intersection of Highway 155 and County Road 189 in Smith County.

Pine Tree Coach: 'Love people, work hard, the rest doesn't matter'

LONGVIEW, TX (KLTV) -

The head football coach at Pine Tree ISD says he is back in the game, five days after being put on administrative leave. 

The Pine Tree ISD board of trustees met in regular session on Monday night. After deliberating for three hours, trustees supported action for the superintendent to carry out a conditional reinstatement of the coach. 

Fitzhenry, who also serves as the school's athletic director, went to his first football practice on Tuesday, since the team's game on August 30th. 

"I love these kids and the Pine Tree community and I'm excited about getting back to work," Fitzhenry said.

The coach was accused of having a physical altercation with a student during the team's August 30th game. The district put the coach on administrative leave and would not discuss their investigation. 

"Any statements made regarding the issue from unofficial sources are merely speculation," said Vickie Echols, Pine Tree ISD's public information officer. 

After their investigation, the district decided to reinstate Fitzhenry as head coach on certain conditions, which they won't reveal. 

"We regret that we can't explain more. I understand there are frustrations when you can't understand what's going on. However, we are legally and ethically bound to protect the rights of our employees and our students," Echols said. 

Fitzhenry also would not comment on the investigation.

"I mean, it's done. Like I said, why complicate it?"

He says his focus now is to help his players achieve their goals, "You know, love people, work hard, and the rest of it doesn't matter. So, that's what I am going to do. I am not going to worry about all that. I am just going to love these kids, work hard and it will all turn out what's right. God has a plan."

And just because he was off the field doesn't mean he isn't ready for Friday's game. 

"I've been watching film and studying things and there have been different people communicating with me," Fitzhenry said at Tuesday night's practice. 

He says the pirates are ready to take on Kilgore and he is ready to turn the focus back on his team. 

Monday's school board meeting was standing room only as football players, students and parents came in with signs in support of the coach.

The last item on the agenda was to discuss possible disciplinary action for Fitzhenry.

"I feel like everything was just blown out of proportion. What they say happened didn't happen, and I feel like it's just dirty politics trying to get him out of his position," said senior football player, Bryndin Hartman who also spoke at Monday's school board meeting.

"As humans we make mistakes, but the overall good of the school, I do believe he has it at heart," said Cindy Russell, who has a son who plays football for Pine Tree High School. 

However, not everyone at Monday night's meeting agreed that Fitzhenry should be reinstated.

"I am also coming tonight to speak on behalf of others who have expressed a reluctance to come or even be seen because they are concerned that their children will be retaliated against should the board decide to stay with the status quo," said a Debbie Garrett, a concerned mother and alumni during the public comment portion of Monday's school board meeting.

"I know that each of you takes your responsibility very seriously. I want to remind you that you ran and were elected to make these difficult decisions even when those decisions may not be perceived with what is popular," she added.

With the majority of those in attendance in support of Fitzhenry, it seems reinstating him was the most popular thing to do and football players said it is for good reason.

"Coach Fitz has been more than just a coach to us. He's brought everybody to game changers, brought us together as a family," Hartman said.

Fitzhenry says he will discuss the situation with his players on Wednesday.

Bench trial scheduled for Tyler man charged in robbery

SMITH COUNTY, TX (KLTV) -

Tuesday morning, a Tyler man waived his right to a trial by jury in an aggravated robbery case.

Timothy Pullins, 34, was arrested in March after Tyler Police say he used a woman's stolen credit card at a fast foot restaurant. According to police, Pullins was one of multiple men who stole the woman's purse when she was walking to her car after leaving Electric Cowboy nightclub. Last month, a judge sentenced Pullins to one year in prison for illegally using the card at a Tyler McDonalds.

Pullins is scheduled to be in court again on September 30th for a bench trial on the robbery charge.

Guardsman holds his own 9/11 march

LONGVIEW, TX (KLTV) -

An East Texas soldier turned a simple gesture into a patriotic salute in his own September 11 march.   Starting off on his own, Army National Guard PFC Blaine Glover marched along Highway 80, from Longview to Marshall, in full utilities and full pack.

"Part of it was, I kind of wanted to feel a little uncomfortable like my friends and brothers over there in Afghanistan are feeling," Glover says.    

Halfway through the walk, he was spontaneously joined by a former Army 101st Airborne member.

"I have friends, several, that are getting ready to deploy in Afghanistan, and I just want people to remember today means something. I just don't want people to forget," Blaine says. 

Taking no money or donations, he got support and encouragement along the way from East Texans. 

The march needed no explanation.

"Had a lot of honks and a lot of people stopping kind of surprised," Glover says.

"I think its great that he's doing this, and more people should be out here to see this. I'm impressed, very impressed," said bystander Paige Crisman.    

"When you feel like you're having a bad day, I guarantee you there's a soldier in Afghanistan that is having a worse day. Just remember, that's all I have to say," Blaine says.

Blaine Glover has seen members of his previous unit deploy overseas and wants East Texans to keep all military members in their prayers.

Suspects wanted for stealing large number of electronics from E. Texas business

LONGVIEW, TX (KLTV) - Local authorities are looking for two suspects who stole a large number of electronic devices from an East Texas store.

According to the Longview Police Department, two unknown suspects broke the glass in a display case and took multiple iPads. The alleged thieves then exited the store and loaded the stolen merchandise into a white Cadillac SUV.

The theft occurred at the Walmart Supercenter located at 4006 Estes Parkway.

Anyone who recognizes the suspects or has information on this crime is asked to contact Detective Gary Shirley with Longview police at 903-237-1199 or Gregg County Crime stoppers at 903-236-7867.

East Texas man waives right to jury trial in 2012 murder case

TYLER, TX (KLTV) - The East Texas man charged with a September 2012 murder appeared in court Wednesday morning.

According to Smith County District Attorney Matt Bingham, 70-year-old Anthony Miller waived his right to a jury trial and will enter a plea in the case October 4. He is charged with the murder of 34-year-old Adam Palacios of Tyler.

Miller was arrested June 3 after new information was gathered regarding Palacios' death, which occurred on County Road 35 in Tyler. Family members reported Palacios missing in September 2012. A few weeks later, Miller called authorities and led them to the man's body.

Miller will remain in the Smith County Jail until his hearing in which he will plead and be sentenced.

The original No. 88 visits Longview

LONGVIEW, TX (KLTV) -

Before Dez Bryant wore No. 88 for the Dallas Cowboys, there was hall of famer Michael Irvin.

Before Irvin wore No. 88, there was Cowboys legend Drew Pearson.  The original No. 88 was in East Texas Wednesday meeting fans and signing autographs.

Pearson was in downton Longview for the grand opening of the new Citizens National Bank.  Pearson took pictures with fans and showed off his Super Bowl ring.  His star remains bright to Cowboy fans.

"We didn't win it every year, but I played in seven NFC Championship games in 11 years," said Pearson.  "Because of that people still recognize and know the name Drew Pearson. This season will be 30 years since I played, but a guy told me the other day good luck the season. He still thinks I'm playing."

Mineola country music star nominated for 6 CMA awards

MINEOLA, TX (KLTV) -

A Mineola country music star is turning heads.

Musician, singer, and song writer Kacey Musgraves is nominated for 6 different Country Music Association, or CMA awards. 

Musgraves is also partnering with another East Texas star, Miranda Lambert.

"It's a nice feeling to watch, I sometimes call them my babies, doing that good," said John DeFoore, the music instructor that taught both Lambert and Musgraves how to play and write songs.

These "babies" DeFoore is referring to are Lambert and rising star Musgraves.

DeFoore started teaching Musgraves when she was 14-years-old, and now she is nominated for CMA's New Artist of the Year.

"Even though she's got a great voice, even though she's beautiful, all these things, what they talk about are her lyrics which makes me happy because that's what I push a lot," said DeFoore.

One of Musgraves' six CMA nominations is for Song of the Year. It's for the song she wrote called Mama's Broken Heart, which is performed by Lambert.

"They are two girls from East Texas and they talk real Texan and they know the same thing; big trucks and big hair and all that different stuff, so they get along pretty good," said DeFoore.

It was that song that Musgraves sent to her old mentor to look at.

"Right after Kacey wrote it she texted me part of the rough recording that they had done that night, right after they wrote it and she sent it to me," said DeFoore.

That's not the only song this rising star is nominated for.

Musgraves' song "Merry go 'Round'" is also topping the charts and is up for an award.

DeFoore says the quiet town of Mineola is full of supporters.

"She is a nice person so she has a lot of friends. It's not just people who knew her, they are people who are friends. Everybody is excited for her," said DeFoore. "There's a difference between being excited because you know someone who got famous and being excited for someone you care about who got famous."

The CMA Awards will take place November 6th.

White Oak ISD: Female student in mascot costume 'roughed up' at football game

BULLARD, TX (KLTV) -

A female student from the White Oak Independent School District wearing a full mascot costume was roughed up by students at Friday night's football game against Bullard, according to White Oak superintendent Mike Gilbert.

"She was fine Friday night," said Gilbert. "She was checked out by medical staff. That was our priority."

Bullard ISD officials are investigating to find out the identity of the attackers.

"We have every confidence in Bullard ISD and are sure they will take every step to make sure nothing like this ever happens again," said the superintendent.

White Oak won the football game 35-14.

Two East Texans nominated for multiple CMA awards

(KLTV) -

Two East Texans have received multiple nominations from the County Music Association after the nominees for the 2013 CMA Awards were announced on Tuesday morning.

Mineola-native Kacey Musgraves, who first turned heads in 2012 with the release of her song "Merry Go 'Round," is nominated for six CMAs, including Female Vocalist of the Year, Single of the Year ("Merry Go 'Round"), Album of the Year ("Same Trailer, Different Park"), Song of the Year ("Merry Go 'Round) and New Artist of the Year. Her sixth nomination is for co-writing Miranda Lambert's hit song "Mama's Broken Heart."

Meanwhile, Lindale's Miranda Lambert received three nods, including Single of the Year ("Mama's Broken Heart"), Female Vocalist of the Year and Music Video of the Year ("Mama's Broken Heart").

The 47th CMA Awards, billed as "country music's biggest night," will be held on Wednesday, November 6 at 7 p.m. on ABC.

Former Longview ISD teacher to stand trial on child sex charges

LONGVIEW, TX (KLTV) -

A trial date has been set for a former East Texas teacher facing child sex charges.

57-year-old Robert Craig Varnell, is scheduled to appear in 188th District Court on September 23rd, according to the Gregg County District Clerk's Office.

Varnell was arrested in May 2011 when he was a teacher at Longview High school on charges of indecency with a child by sexual contact and sexual assault of a child.

He remains jailed on a $1.25 million bond.

Exclusive: Dash cam video shows high-speed chase end in wreck

TYLER, TX (KLTV) -

An East Texas man is in jail after leading police on a high-speed chase from Chandler to Tyler.

A Chandler Police officer attempted to stop 53-year-old Jimmy Dewayne Lee for speeding. However, Lee would not stop. Police say he already had a felony warrant out for a parole violation.

Exclusive dash camera video shows Lee driving nearly 100 miles per hour and later wrecking in front of a Tyler school.

Chief Reeves says Lee was driving 47 MPH in a 30 MPH zone in a silver PT Cruiser on Farm to Market Road 315 in Chandler. According to Reeves, when an officer attempted to pull Lee over, he would not stop and led officers on a chase into Smith County. Tyler Police say they were called and informed of the chase by the Chandler Police Department.

Chief Reeves said Lee drove at speeds of up to 95 and 100 miles per hour.

"He got to Glenwood and made a sudden right turn on Glenwood and went over into oncoming traffic, or oncoming roadway. He went under the overpass, just barely making it, and from there he turned onto Vine street," explains Reeves.

Tyler Police officers say Lee was driving east on Bryan Street and attempted to turn north on College Street when he failed to negotiate the turn. Lee crashed the vehicle into a gate surrounding St. Gregory's Catholic School. According to Reeves, Lee fled the scene on foot but ran into an area with a locked gate.

Reeves says Lee originally resisted arrest until a Smith County officer threatened to use a taser on the suspect.

"The suspect apparently had been tased before or had seen what it does and he quickly gave up and put his hands behind his back as they were scuffling on the ground," says Chief Reeves.

Reeves says both Lee and the officer were checked out at the hospital for minor injuries.

Chief Reeves says Lee had felony warrants for parole violation and was also in possession of a controlled substance.

"We're not sure at this time if it was crack cocaine or methanphetamines. It will be tested and we'll find that out later," says Reeves.

Lee was booked into the Henderson County Jail and charged with evading arrest, fleeing and possession of a controlled substance.

Longview hospital reveals new wings, rooms

LONGVIEW, TX (KLTV) -

There was a big reveal today at Longview Regional Medical Center. A hundred new rooms, two times the operating and ICU space, and three times the postpartum and women's services areas.

The hospital had a ceremony on Tuesday morning to reveal the $250 million expansion. New private rooms come with private bathrooms.

One doctor says this expansion won't just benefit those using it, but the entire city.

"Every town like Longview competes for the business within the town, but you also compete for business that's outside of the town, and every patient that comes to Longview for health services, their families come, they shop in our store, they stay in our motels and hotels, and that provides an economic benefit for the community as a whole," Dr. Robert Wheeler, an OBGYN at the hospital, said.

The new portion of the hospital will be officially up and running at 5:45 a.m. Saturday.

Eat breakfast, lose more weight: true or false?

When the alarm clock goes off, some claim breakfast should go on, but a group of Vanderbilt University Doctors disagrees. A new study published in The American Journal of Clinical Nutrition says that's just a rumor, and that eating, or not eating, breakfast has no effect on weight gain or loss.

Danielle Townsend, a nutritionist at Mother Frances Hospital, is suspicious.

"I think that studies come out and we change our theories about things a lot," she said.

The 12-week-long study focused on two groups of subjects, those who normally ate breakfast and those who normally did not. All were asked to consume the same amount of calories which did cause them to lose weight. All were advised not to eat breakfast.

Those who normally did not east breakfast lost an average of 17 pounds, while those who normally did lost an average of 20 pounds.

"You know, I've done a lot of interviews, and it all comes down to moderation and what you're choosing and making a healthy habit and eating," Townsend said.

Having a healthy breakfast is different than having one high in fat and sugar, she said. Nonetheless, she will continue to urge her patients to fry up those eggs.

"There's a lot of myths that have been debunked and there are a lot of different thoughts on these things and I'm sticking with breakfast."

The study also claimed much misinformation came from past studies that have since been proven skewed. Ultimately, Townsend says, it's up to the individual's body.

"You know, if it's working for you, it's working for you. If it ain't broke, don't fix it."

Another recent study supports this one. It was done at Cornell University and found those who did not eat breakfast did eat more at lunch, in general, but their total caloric intake was still less than those who ate breakfast.

Vandals place cardboard planes on 9/11 memorial in Louisiana

LAFAYETTE, LA (KATC) - Police in Louisiana are searching for the culprit who vandalized a September 11 memorial in downtown Lafayette, on the 12th anniversary of the attacks.

Someone placed two cardboard cutout images of crashing planes at the site. Authorities have since removed them.

Each plane had the letters "NWO" and an image of an eye in a triangle, a reference to the New World Order conspiracy theory.

The theory includes the belief that the 9/11 attacks were carried out by the United State government.

Community still working to reopen Cozby-Germany hospital

GRAND SALINE, TX (KLTV) -

An East Texas community is continuing to fight for their local hospital to be reopened.

Wednesday, residents of Grand Saline organized their next community meeting in support of Cozby-Germany Hospital. The ladies auxiliary assisted former hospital employees in setting up committees for volunteers to sign up for at the next town hall meeting.

Community members who want to get involved in the effort to raise money and reopen the hospital is asked to attend a meeting on Monday, September 16 at 7 p.m. The meeting will be held in the Grand Saline High School Cafetorium.

The hospital was closed in late august due to financial problems.

ETX Fire Academy honors 9/11 victims at graduation

KILGORE, TX (KLTV) -

The Kilgore College Fire Academy paid tribute Wednesday night to the 343 firefighters who died 12 years ago on 9/11.

Organizers scheduled the academy's 88th graduation on 9/11 so the graduates will never forget the New York firefighters who made the ultimate sacrifice.

"One reason I decided to have it tonight was so that this generation of firefighters never forgets the importance of this day. We're also introducing the cadets to the brotherhood of firefighting," said Mike Fennell lead instructor at the Kilgore College Fire Academy.

"It's very special to me. It's a memorial thing. It's something I'll never forget," said Wesley Daugherty, one of the graduates at the ceremony.

Daugherty was in first grade when the attacks happened, "I didn't know exactly what was going on but I knew we were going to war though because my parents brought me up and they told me."

Like many people, graduate Jovane Rossum remembers exactly what he was doing that day, "I was actually in chemistry class. Our teacher turned on the television and we actually watched the second plane crash into the towers."

Holding the graduation ceremony on 9/11 gave everyone involved a chance to pause honor the victims of the deadly attacks.

"We are never going to forget the sacrifice that the members of the FDNY made 12 years ago because they paid the ultimate price," Fennell said.

The graduates say this is an emotional celebration and they are proud to join in the bond that comes with putting your life on the line for others.

"All of us made it and it's just a very special feeling to be graduating on 9/11," Rossum said.

15 students graduated at Wednesday night's ceremony.

Gregg County Judge Bill Stoudt and Texas Assistant State Fire Marshal Kistner Stoudt were guest speakers at the event.

Tyler holds 9/11 ceremony: 'To honor those who have fallen'

TYLER, TX (KLTV) -

Wednesday morning, a September 11 ceremony took place outside Tyler City Hall. The ceremony was conducted by Mayor Barbara Bass, the Tyler Fire Department Honor Guard and the Tyler Police Department Honor Guard.

With the flag at half mast, Mayor Bass made a moving speech to remember those who have fallen.

The speech was followed by the playing of 'Taps' on the trumpet. 'Amazing Grace' was also played on the bagpipes.

The ceremony ended in prayer.

"We came today to remember the fallen and what first responders and military did on the day on that attack which was 12 years ago," said Don Martin, Public Information Officer with the Tyler Police Department. "It's so important. It's almost like Pearl Harbor. It's a day we will never forget and we lost many lives, close to 3,000. We come together to remember them and make sure they didn't die in vain."

Local, statewide observances held for Sept. 11

TYLER, TX (KLTV) - Public and private remembrances will be held Wednesday in East Texas to commemorate the twelfth anniversary of the Sept. 11, 2001 terrorist attacks.

Nearly 3,000 people lost their lives at the World Trade Center, the Pentagon, and on Flight 93 in Shanksville, Pennsylvania.

Governor Perry has asked state and local governments to observe Patriot Day with appropriate programs and activities.

All Texas and U.S. flags will be flown at half-staff Wednesday.

Governor Perry has asked everyone in Texas to observe a personal moment of silence to remember the terrorist attacks, honor the victims, and reflect upon the meaning of the day.

And for the first time since September 11, 2001, a new law passed by the Texas Legislature last spring will affect how Texas public schools will commemorate the 9/11 attacks.

House Bill 1501, introduced by Rep. Richard Peña Raymond, D-Laredo, says that when 9/11 falls on a regular school day, each public elementary and secondary school will observe a minute of silence at the beginning of first period class.

Immediately before the minute of silence, a class instructor will make a statement of reference to the memory of the people who died on September 11, 2001.

In Tyler Wednesday morning, a ceremony will be held to mark the twelfth anniversary of the attacks.

The ceremony will be conducted by Tyler Mayor Barbara Bass and honor guards from the police and fire departments.

The ceremony starts at 9 a.m. outside Tyler City Hall on North Bonner Avenue.

Also, the Kilgore Fire Academy will honor the memory of 9/11's fallen firefighters at its graduation ceremony Wednesday night.

The ceremony is set for 6:30 p.m. at the Bert E. Woodruff Adult Education Center in Kilgore.

Gregg County Judge Bill Stoudt and Texas Assistant State Fire Marshal Kelly Kistner will be speaking.

Fifteen new firefighters will graduate Wednesday as they honor the 343 firefighters who gave their lives 12 years ago.

Crews respond to overnight train derailment

LONGVIEW, TX (KLTV) -

Longview emergency crews responded to a train derailment overnight.

Officials say the derailment happened just after 12:30 am Sunday on Gumsprings road near Cotton street and Eastman road in Longview.

Authorities say a Burlington train was switching cars when two tank cars derailed. One was carrying diesel fuel which did not spill, while the second car spilled a small amount of tar.

Officials say there was no danger to the public. Longview fire officials responded to the scene and railroad workers remain on the scene at this hour.
