China to offer tax breaks to solar power manufacturers

SHANGHAI, Sept 29 (Reuters) - China's Ministry of Finance announced it will offer tax breaks to manufacturers of solar power products on Sunday, as China moves to support an industry still struggling to deal with massive overcapacity and weak demand.

The ministry said in a short statement on its website that producers of solar power products will receive immediate refunds of 50 percent of value-added taxes.

The National Development and Reform Commission provided subsidies for solar power stations in late August.

"China's bloated photovoltaic industry still faces a grim outlook as many companies are deeply mired in debts," said a report on the official Xinhua news service discussing the announcement.

It cited data from the China Renewable Energy Society saying that the country's top 10 solar panel makers are up to 100 billion yuan ($16.34 billion) in debt, with a debt to asset ratio above 70 percent on average.

Beijing has said it wants to consolidate the industry, but the sector continues to enjoy protection at the central and local level; the latter is particularly strong because solar power companies are frequently major employers.

China's LDK Solar Co Ltd partly defaulted on a bond payment in April, then failed to meet another payment on time in August.

China's Suntech Power Holdings Co Ltd said Chief Executive David King had resigned from the company in mid September, weeks after three directors left amid the solar panel maker's efforts to restructure its debt.

Suntech's Chinese lenders dragged its unit Wuxi Suntech into insolvency proceedings after it defaulted on $541 million in bonds after the business was hit by a glut in solar panels.

Samsung abused its rights as a standard-essential patent holder, Apple said Wednesday, by filing a complaint with the International Trade Commission before even trying to come to an agreement with the Cupertino company over licensing terms.

Apple noted the abuse in an ITC statement on Wednesday, which was subsequently discovered by FOSS Patents on Thursday. In it, Apple summarizes why a recent FRAND decision ? from the case RealTek v. LSI/Agere ? runs parallel to the complaint Samsung lodged with the ITC.

"The Realtek case is strikingly similar to the instant case. Samsung brought an ITC complaint before making any offer specific to its declared-essential patents, let alone a FRAND-compliant offer. Just as in Realtek, when Apple responded to the ITC complaint by requesting that Samsung provide FRAND terms for the specific asserted patents, Samsung responded by making a non-FRAND demand based on the total price of the accused Apple products--rather than the cost of the relevant accused components. Indeed, Samsung's conduct here is even more egregious--[redacted] In short, just as in Realtek, Samsung's pursuit of an ITC exclusion order directly conflicts with its FRAND commitments."


The RealTek case involved a dispute over the IEEE 802.11 WLAN standard, with Agere, the patent holder, suing RealTek for alleged infringement. The court issued a summary judgment finding in RealTek's favor, ruling that Agere had breached its obligation to license essential technologies in a fair, reasonable, and non-discriminatory (FRAND) manner. The court found further breach in that Agere had sought an injunction before even offering licensing terms.

Apple, in pointing to the RealTek case, is hoping for the same sort of decision to be handed down in its own proceedings. In the RealTek case, the court barred the patent holder from asserting its patent in court without first extending a FRAND offer.

The ITC is scheduled to render a final decision on the FRAND patent case brought by Samsung against Apple in the coming weeks.

Samsung is in violation of so many things, filing a suit before it was necessary was probably a knee-jerk reaction from being in court so much.

Bunch of thieves. I hope Samsung gets nailed to the wall. Shame that our court system is so incredibly slow and ineffective in dealing with such violations in a timely manner.

So when will they schedule a hearing? September of 2016?

Things just keep getting worse for Samsung. Not only were their demands outrageous (as Motorola was recently found to be), but they never even made an offer in the first place.

Where are all the people who posted that Apple was an "unwilling licensee"? How can you be unwilling without there even being an offer in the first place? Samsung's true colors are being revealed more and more as these cases progress. A truly corrupt company.

Imagine they'll all avoid this discussion just like they're avoiding the Google 3D Maps discussion.

What do you think ties the court systems up? I don't think it's an issue of multitudes of empty courtrooms and judges with downtime.

Samsung's true colors were always out there for the world to see since the moment they came out with their iClone. ?Fantards, iHaters, and spinmeisters were the ones that kept trying to deflect attention to what was important to them - just hating Apple for the sake of it.

Best Buy to offer $50 off all iPhone 5 & 4S models starting SundayBy AppleInsider Staff

Starting this Sunday, electronics retailer Best Buy will be offering $50 off the purchase of any new iPhone model with a service contract, marking a rare discount opportunity for Apple's smartphone lineup.

The upcoming sale will be a four-week-long promotion that applies to the iPhone 5 and iPhone 4S on Verizon, AT&T, and Sprint, the three largest carriers in the U.S. The discount does not apply to the iPhone 4, which is already free with a two-year service contract, the company confirmed to AppleInsider.

The sale means shoppers will be able to buy an iPhone 4S for $49, a 16-gigabyte iPhone 5 for $149, a 32-gigabyte iPhone 5 for $249, or the top-end 64-gigabyte iPhone 5 for $349.

Customers will need to buy a new two-year service contract in order to receive the typical handset subsidy and Best Buy's special $50 discount. Discounts on some Android phones, including the Samsung Galaxy S III, are also planned to run from May 26 to June 1.

This, plus all the other iPhone 5 promotions that have been springing up over the last few weeks, sounds like clearing out inventory to me.

Unlikely that it's indicative of an imminent iPhone release with iOS 7 beta not yet released to developers. Unfortunately, it is more likely an indicator of slowing iPhone 5 sales.

I have not bought into the panic alarms, but I think Apple has made some missteps over the last 9 months. How many new things were announced last fall when some (especially iMac's) were not actually available because of supply shortages. Apple needs to have some sort of new or refreshed product announcement each quarter. That's doable. They just need to space them out a little.

I also believe the time has passed when Apple can afford to only change the appearance of the iPhone every two years. That was fine and made sense when there was no real competition. Now there is lots of competition. Apple needs to deliver something new each year and one of those things needs to be an iPhone with a larger screen. Not 5" large but maybe 4.2" with a 4:3 ratio.

But I would say 4.5-4.7" would be a better fit. 4.2 is not much bigger than they already have. Ideally I'd like to see a 4.7 to match the HTC One.?

I really don't care about iOS 7 or OSX 10.9, and I'm sick of new OS updates artificially holding back hardware updates. If they delay the rMBP refresh for the sake of 10.9, I'm going to be one unhappy camper. As for iOS 7, release the stupid beta already and get it out to developers. 6 saw what, 7 betas before GM? Get it out into the real world so we the developers can get the bugs out. That, or move WWDC to May next year and stop stalling.

False Advertising.? I just got off the phone with Best Buy, the cost of the iPhone 5?- 16GB?is $199.? They said Apple raised their prices "overnight" to $249, and they are promoting $50 off to get it back to the $199.?? The representative on the phone and at the store knew nothing about it.....?
